Addressing bottlenecks in the delegation of approval authority
The Resolution provides measures to resolve issues arising from the delegation of approval authority for specific contents under the Law on Petroleum No. 12/2022/QH15 (issued on November 14, 2022) and Decree No. 45/2023/ND-CP (dated July 1, 2023) detailing the implementation of the Law on Petroleum.
The regulation applies to Vietnamese and foreign organizations and individuals involved in oil and gas activities in Vietnam.
PVN is authorized to approve specific oil and gas activities
Based on the Law on Petroleum 2022 and Decree No. 45/2023/ND-CP, the Government assigns PVN to review, approve, and take responsibility for certain oil and gas activities, ensuring no adverse impact on national defense and security. These include:
1. Approval of the overall field development plan (FDP) for oil and gas fields (excluding onshore projects or projects with integrated onshore and offshore components), as well as adjustments to the FDP in case of development plan changes.
- PVN shall carry out appraisal and approval following its internal procedures.
- PVN shall take responsibility for capital utilization in cases where it participates in petroleum contracts as a contractor.
2. Approval of adjustments to early production plans when:
- The total investment decreases; or
- The total investment increases by less than 10% (excluding cases involving the construction of additional platforms).
3. Approval of adjustments to field development plans when:
- The total investment decreases; or
- The total investment increases by less than 10% (excluding cases involving the construction of additional platforms).
4. Approval of adjustments to decommissioning plans when estimated costs decrease or increase by less than 20% compared to the most recent plan approved by the Ministry of Industry and Trade.
5. Approval of initial petroleum resource and reserve reports for fields or discoveries with total oil-in-place below 30 million cubic meters and total gas-in-place below 30 billion cubic meters (excluding reports prepared by PVN itself as the operator or investor).
PVN will issue detailed internal guidelines and procedures for all appraisal and approval processes mentioned above, in accordance with the relevant provisions of Decree No. 45/2023/ND-CP.
Responsibilities and implementation
PVN shall report to the Ministry of Industry and Trade on the results of the delegated approval activities.
Resolution No. 66.6/2025/NQ-CP takes effect from the date of signing (October 28, 2025) and remains valid until February 28, 2027.
If the Law on Petroleum is amended or supplemented before this date, implementation shall comply with the provisions of the amended law./.
