Abolish all regulations on transferring power projects (using state capital) to EVN for management

According to a report from the Department of Public Asset Management (Ministry of Finance), Previously, the transfer of power projects invested with state budget capital to EVN for management was carried out according to Decision No. 41/2017/QD-TTg. However, in practice, many limitations and shortcomings have arisen, leading to the number of transferred power projects accounting for only about 10% of the number of power projects that EVN agreed to receive. Furthermore, Decision No. 41 was built based on the Law on Management and Use of State Assets (2008) with many contents that were no longer consistent with the provisions of the Law on Management and Use of Public Assets (2017).
In order to overcome the shortcomings and limitations of Decision No. 41, to accelerate the process of transferring power projects that are public assets managed by agencies, organizations and units to EVN to ensure safety and efficiency, on January 10, 2024, the Government issued Decree No. 02/2024/ND-CP on the transfer of power projects that are public assets to EVN, effective from March 1, 2024.
This Decree has provisions on transitional handling for cases that are being transferred under Decision No. 41. Thus, Decision No. 41 is no longer applied in practice.
To ensure the consistency, synchronization, and transparency of the legal system, facilitate the application and enforcement of the law, and contribute to making the legal system streamlined and accessible to people and businesses, the Ministry of Finance has submitted to the Prime Minister the entire abolition of Decision No. 41/2017/QD-TTg./.
